Welcome to the ItsMyLinks.com website (the "Site"). When using the Site and/or any related services (the Site and related services are hereinafter referred to as the "ItsMyLinks Service"), you agree to the terms and conditions set forth herein (the "Terms of Service"). If you do not agree to these Terms of Service, you are not authorized either to use the ItsMyLinks Service (including any portion thereof) or to sign up for Site membership.
General Terms of Service
You are permitted to use the ItsMyLinks Service for personal use, including personal commercial self-promotion. Prohibited uses include, without limitation: spam, fraud, illegal activity, harassment, or reselling the ItsMyLinks Service itself to any third party.
By using the ItsMyLinks Service, you agree to be legally bound by and abide by the Terms of Service, just as if you had signed this Agreement. If you do not comply with these Terms of Service at any time, we reserve the right to terminate your access to all or any aspect of the ItsMyLinks Service. We may discontinue or alter all or any aspect of the ItsMyLinks Service, including but not limited to: (i) restricting the time the ItsMyLinks Service is available; (ii) restricting the amount of use permitted; and (iii) restricting or terminating any user's right to use the ItsMyLinks Service, at our sole discretion and without prior notice or liability. You are responsible for all charges associated with connecting to or otherwise accessing the ItsMyLinks Service. You are also responsible for obtaining or providing all access lines, telephone and computer equipment, or other device necessary to access or use any aspect of the ItsMyLinks Service.
In order to permit us to protect the quality of our products and services, you hereby consent to our employees and agents being able to access your account and information on a case-by-case basis to investigate complaints or other allegations of abuse, including suspected violations of these Terms of Service. We reserve the right to disclose the existence, occurrence, or results of such an investigation except to the extent such disclosure is prohibited by law.
Eligibility
You must be at least eighteen (18) years of age to use the ItsMyLinks Service. By using the ItsMyLinks Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract under the laws of the United States or other applicable jurisdiction. The ItsMyLinks Service is not directed at persons under the age of 18, and we do not knowingly collect personal information from anyone under 18.
You further represent that you are not a person barred from receiving the service under the laws of the United States or other applicable jurisdiction.
Content and Materials
You acknowledge that the ItsMyLinks Service contains information, software, photos, video, text, graphics, music, sounds, or other material (collectively, "Content") that are protected by copyrights, patents, trademarks, trade secrets, or other proprietary rights. All Content is copyrighted as a collective work under U.S. copyright laws.
All other trademarks appearing on the ItsMyLinks Service are trademarks of their respective owners. ItsMyLinks's partners may also have additional proprietary rights in the content that they make available through the ItsMyLinks Service.
Creating a Profile
If you elect to establish a password-protected profile on the Site (which is required only if you want to personalize the ItsMyLinks Service), you agree to provide true, accurate, current, and complete information about yourself as prompted by the ItsMyLinks Service's registration form (such information being the "Registration Data") and to maintain and promptly update the Registration Data to keep it accurate. If you provide any information that is untrue, inaccurate, or incomplete, or ItsMyLinks suspects that such is the case, ItsMyLinks has the right to suspend or terminate your account and refuse any and all current or future use of the ItsMyLinks Service (or any portion thereof).
As part of the registration process, you will be asked to select a username and password. We may refuse to grant you a username that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, or may cause confusion with another user's account, as determined by us in our sole discretion.
YOU WILL BE RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY AND USE OF YOUR USERNAME AND PASSWORD AND AGREE NOT TO TRANSFER OR RESELL YOUR USE OF OR ACCESS TO THE SITE TO ANY THIRD PARTY. YOU ARE ENTIRELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT. If you have reason to believe that your account with us is no longer secure, you must promptly change your password from My Account Page.
User Compliance Responsibilities
You are solely responsible for compliance with all applicable laws and regulations relating to the content you post, link to, or otherwise transmit through the ItsMyLinks Service. This includes, without limitation, any record-keeping requirements, age-verification requirements, licensing requirements, tax obligations, advertising disclosure obligations, or other legal requirements that may apply to producers, hosts, distributors, or sellers of the content you reference.
ItsMyLinks does not host, produce, originate, manufacture, or distribute any third-party content accessed via links you post through the ItsMyLinks Service. Such content is hosted by, produced by, and the responsibility of the third-party websites to which you link, and their respective operators.
You agree not to use the ItsMyLinks Service to post, link to, or transmit any content that:
- Violates any applicable federal, state, local, or international law or regulation
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property right
- Is unlawful, threatening, abusive, harassing, defamatory, libelous, or invasive of privacy
- Constitutes spam, fraud, phishing, malware, or any other deceptive practice
- Is sexually explicit material involving minors or any other content depicting child exploitation
- Promotes violence, terrorism, or illegal activity
ItsMyLinks reserves the right (but is not obligated) to review, moderate, or remove user-submitted content at its sole discretion.
Affiliate Relationships Disclosure
You acknowledge and understand that ItsMyLinks may earn affiliate commissions, referral fees, or other compensation when you or visitors to your profile click on links presented through the ItsMyLinks Service and complete transactions or sign up for services on third-party websites ("Partner Sites").
Specifically: outbound links from profile pages on ItsMyLinks may include referral identifiers that compensate ItsMyLinks (or its affiliated entities) for traffic and conversions delivered to Partner Sites.
We disclose these relationships in compliance with the Federal Trade Commission's guidelines on endorsements and material connections (16 C.F.R. Part 255). The presence of affiliate compensation does not affect the price you or your visitors pay on Partner Sites. DMCA Notice and Takedown

**Counter-Notification.** If you believe your content was removed in error, you may submit a Counter-Notification containing the information required under 17 U.S.C. § 512(g)(3). Mandatory Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
**Agreement to Arbitrate.** You and ItsMyLinks agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the ItsMyLinks Service (collectively, "Disputes") will be settled by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
**Arbitrator's Authority.** The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any Dispute, including any claim that all or any part of these Terms of Service are unenforceable. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity.
**Class Action Waiver.** YOU AND ITSMYLINKS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and ItsMyLinks agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
**30-Day Opt-Out.** You have the right to opt out of these arbitration provisions by sending written notice of your decision to opt out to legal@itsmylinks.com within thirty (30) days after first accepting these Terms of Service. Your notice must include your name and address, and a clear statement that you do not wish to resolve disputes through arbitration. If you opt out, all other terms will continue to apply.
**Carve-Outs.** Notwithstanding the foregoing, either party may bring an individual action in small claims court. The arbitration agreement does not preclude you from filing complaints with a federal, state, or local agency. Further, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights.
**Governing Law.** These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict of laws principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions.
**Severability.** If any portion of this arbitration provision is found unenforceable, then that portion will be severed and the remaining portions will continue in effect.
Termination and Modification
You agree that ItsMyLinks, in its sole discretion, may terminate your password, account (or any part thereof) or use of the ItsMyLinks Service, and remove and discard any Content within the ItsMyLinks Service, for any reason, including, without limitation, for lack of use or if ItsMyLinks believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Further, you agree that ItsMyLinks shall not be liable to you or any third-party for any termination of your access to the ItsMyLinks Service.
We reserve the right, at our discretion, to change, add, or remove portions of these Terms of Service at any time. Please check back at this webpage periodically for changes (you can determine if these Terms of Service have been modified since your last visit by referring to the "Effective Date" at the top of this webpage). Your continued use of the ItsMyLinks Service following the posting of changes to these terms will mean you accept those changes. For material changes, we will provide at least thirty (30) days' notice via email to registered users or via prominent notice on the Site before the changes take effect.
